Section 129 Notice

Section 129 Notice
Before a credit provider can take you to court over unpaid debt, they're legally supposed to send you a Section 129 notice. It tells you you're in default, says what you owe, and gives you 10 business days to sort it or seek a debt counsellor. If they skip this step, the court can throw out their case. It's your last real chance to fix things before things get hectic.

Usage Examples

"Andile got a Section 129 notice from African Bank saying he was three months behind. He called immediately, negotiated a payment plan, and avoided court. It actually worked."

"Zanele's lawyer argued that the lender never sent a proper Section 129 notice, so the court case got tossed out. She got a second chance to fix the debt."

"The Section 129 notice is your best weapon. If you respond quickly with a plan or get a debt counsellor involved, most lenders will negotiate instead of going to court."
